Transcript of William Ludlam�s Will & Probate 1812

William VYSE, Clerk, Doctor of Laws, Vicar General of the Honourable & Right Reverend Father in God James, Divine Permission, Lord Bishop of Lichfield and Coventry, To Thomas CORNTHWAITE and Thomas WARD  Clerks jointly, and severally, sendeth Greeting, Whereas it has been alledged, before the Rev. Charles BUCKERIDGE, D.D. our Surrogate, that William LUDLAM ~late of Southwingfield ~in the County of Derby  and Diocese of Lichfield and Coventry, Farmers  deceased, duly made and executed, his last Will and Testament, in writing, and therein named Phineas LUDLAM of Morewood Moor in the Parish of Southwingfield aforesaid Farmer and John REDFERN of the Hollinss in the Parish of Crich in the said County Farmer Executors thereof.

We therefore by these presents, commit and grant, to you jointly, and severally, full power and authority to administer the Oath under-written, to the said Executors, and the said Oath being administered, you are to certify the same to us or our said surrogate, and subscribe your name thereto, together with these presents, within three months from the date hereof. Provided nevertheless that the commission shall be of no effect, unless so certified and transmitted to us within that time. Dated at Lichfield, the twenty-sixth day of September in the year of our Lord 1812.

The Oath

Your Oath is, that the writing now showed unto you contains the original last will and testament of William LUDLAM deceased, so far as you know and believe: that you are the Executors named therein, and will faithfully perform that office, by paying his just debts and the legacies therein bequeathed, so far as his personal estate will extend, and the law require from you; that you will make a true, and perfect, inventory thereof, and exhibit the same into the Registry of the Bishop�s Consistory Court of Lichfield, and also a just account of your Executorship, when you are thereunto lawfully required, and that the Goods Chattels and Credits of the said deceased as they were at his death without deducting any debts owing by the said deceased therefrom, did not amount in value to the sum of Three Hundred Pounds

On the Thirtieth day of September 1812 this commission was duly executed and the said Phineas LUDLAM of the Parish of South Wingfield and John REDFERN of the Parish of Crich were duly sworn according to the above oath before me  Thomas CORNTHWAITE  Vicar of Crich Commissioner.

William LUDLAM�S Will 1812

This is the last Will and Testament of me William LUDLAM of Wingfield Park in the Parish of Southwingfield in the County of Derby Farmer made this Thirteenth day of April in the year of our Lord One Thousand eight hundred and twelve, as follows.

First I will order and direct that all my just debts and Funeral expenses be fully paid off and discharged by my Executors hereinafter named by and out of my personal estate. Also, I give and bequeath unto my son Phineas LUDLAM and John REDFERN of the Holliss in the Parish of Crich and County of Derby, All and singular my Personal Estate, Goods, Chattels, Monies and Effects to hold them the said Phineas LUDLAM & John REDFERN, their Executors and Administrators In Trust. That they do and shall as soon as conveniently may be after my decease, dispose of and convert my said personal estate and effects into ready money and after payment of my said just Debts and Funeral expenses, and the expenses attending the execution of this Trust.

In Trust to pay and divide the residue and remainder of such Money, Personal estate and effects unto and equally betwixt my Children, namely the above men =

Named Phineas LUDLAM and William LUDLAM, Isaac LUDLAM, Nathan LUDLAM, Mary TAYLOR, Hannah PEARSE and Ann AMATT equally share and share alike. The said Ann AMATT to enjoy and receive the legal Interest of her share only, for and during the term of her natural life  and at her decease, her share shall be equally divided amongst the Children that she had by her late husband John AMATT. Also I do Hereby give and Bequeath unto John LUDLAM son of my said daughter Mary TAYLOR Six Pounds payable out of my said personal estate, with which Legacy I do hereby charge the same payable at the end of Twelve months after my decease. Also I give and devise all and singular my Messuages, Lands, Tenements and Hereditaments whatsoever or wheresoever which I am seized of or entitled unto to my said Son Phineas LUDLAM and John REDFERN and their respective Heirs. To Hold to my said son Phineas LUDLAM and John REDFERN and their respective Heirs and assigns equally Share and Share alike as Tenants in Common and not as Joint Tenants. But upon this Condition nevertheless, and I do hereby charge and make liable my said real Estate with the payment of such sum of Money to my Six other Children in manner here after mentioned, As shall be equal to six seventh parts (the whole to be ****** in seven parts) of the full and fair value of such real estates at the time of my decease and for the purpose of ascertaining such value of my said real Estate, or Sum of Money so to be payable to my said other six Children thereout I do expressly Will order and direct that my said Son Phineas LUDLAM and John REDFERN shall appoint one person and my said other Children one other person, as Valuers thereof, and such Valuers thereof shall appoint a third person and the Award of such Two valuers or such Third Person, if they shall disagree shall be final and conclusive between my said children as to the Valuation of my said real Estates, and the sum to be ascertained and become payable as aforesaid thereout. And I do will and direct that my said son Phineas LUDLAM and John REDFERN shall pay and divide such sum of Money as shall be so ascertained to be the value of six seventh parts of my said real Estates unto my said sons and daughters namely William LUDLAM, Isaac LUDLAM, Nathan LUDLAM, Mary TAYLOR, Hannah PEARSE and Ann AMATT equally share and share alike. The said Ann AMATT to receive the Legal Interest of her share only during the term of her natural life, and at her decease be equally divided amongst the children that she had by her late husband John AMATT. Nevertheless I do hereby charge the said Shares to which My Son Isaac LUDLAM will be entitled to with Sum or Sums of money which I have advanced or given security for, and the same shall be considered as received by my said son Isaac LUDLAM in part of his Share and to be withheld and not paid by the said Phineas LUDLAM and John REDFERN  and I do hereby order and Direct that the remaining seventh share shall be kept and retained by my said son Phineas LUDLAM his heirs and assigns  and my Will and mind is that if my sons Phineas and Nathan should Die before their ne = respective wives, I do hereby Will and Direct that their said Wives shall enjoy and receive the said shares for and during the Term of their natural lives. I do Hereby appoint the said Phineas LUDLAM and John REDFERN joint executors of this my Last Will and hereby revoking all former Will and Wills made by me and declare this only to be my Last Will and Testament. In Witness whereof I have hereunto set my Hand and Seal the day and Year first above written.

Comments: It should be noted that Isaac LUDLAM mentioned within this will was executed in 1817 for the part he played in the Pentrich Revolution.
